Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. NextWave Doral Landscapers reserves the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.

Services

NextWave Doral Landscapers provides landscaping and related outdoor maintenance services including but not limited to lawn care, landscape design, hardscaping, irrigation, tree services, and seasonal cleanups. All services are subject to availability and scheduling. We reserve the right to refuse service to any customer for any lawful reason.

Service estimates are provided free of charge and are valid for 30 days unless otherwise specified. Actual costs may vary based on site conditions discovered during work. We will notify you of any significant changes before proceeding with additional work.

Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, check, and major credit cards. For recurring maintenance services, payment is due at the time of each visit or according to the agreed schedule.

Late payments may be subject to interest charges of 1.5 percent per month or the maximum allowed by law. If legal action is required to collect payment, you agree to pay all collection costs including reasonable attorney fees.

Scheduling and Cancellations

We make every effort to arrive during scheduled time windows. Weather conditions, equipment issues, or other unforeseen circumstances may require rescheduling. We will notify you as soon as possible if changes are needed.

Customers must provide at least 24 hours notice to cancel or reschedule a service appointment. Cancellations made with less than 24 hours notice may be subject to a cancellation fee. For recurring services, at least one week notice is required to discontinue service.

Property Access and Safety

Customers are responsible for ensuring safe access to work areas and notifying us of any hazards such as underground utilities, irrigation lines, septic systems, pet containment systems, or other hidden features. We are not liable for damage to unmarked or undisclosed underground features.

Please secure pets during our visits. We will take reasonable precautions but cannot be held responsible for pets that escape or interfere with work. If unsafe conditions prevent us from completing work, you will still be responsible for any trip charges or partial service fees.

Warranties and Guarantees

We stand behind our work. If you are not satisfied with any service, please contact us within 7 days and we will make it right. Plant materials carry different warranties depending on type and season. We will explain specific warranties for plants at time of installation.

We are not responsible for plant failure due to factors beyond our control including extreme weather, improper watering, animal damage, or disease. Hardscape installations are warranted against defects in workmanship for one year from completion.

Limitation of Liability

NextWave Doral Landscapers carries general liability insurance. Our total liability for any claim related to our services is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages. Some states do not allow limitation of certain damages, so these limitations may not apply to you.

Intellectual Property

All content on our website including text, images, logos, and design elements is the property of NextWave Doral Landscapers and is protected by copyright law. You may not reproduce, distribute, or use our content without written permission. Landscape designs created for clients remain our intellectual property unless otherwise agreed in writing.

Governing Law

These Terms of Service are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Miami-Dade County, Florida. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in effect.
